NOTICE OF EMERGENCY MEETINGOREGON STATE BOARD OF TOWING

Under current Oregon Law:

  • The Board has the authority to investigate complaints against tow companies for violations of Oregon’s laws, and the authority to enforce disciplinary actions against towers for violations.
  • The Board does not have the legal authority to investigate property managers, law enforcement, code enforcement, and other individuals or government agencies with the legal authority to request a vehicle be towed.
  • A full investigation must be conducted prior to Board determination of appropriate disciplinary action. Investigations may take several months to complete.
  • The Board does not have the authority to require a tower to refund any portion of tow fees or costs, and there is no guaranty or expectation that a complainant will be refunded any portion of money paid for an unlawful tow through the Board’s disciplinary actions. Reimbursement for fees paid for unlawful tows should be negotiated between the vehicle owner and any of the following: the property owner, the tow company, insurance or resolved through civil action.
  • Damages to vehicles that may have resulted from the tow or storage of a vehicle are outside of the Board’s legal authority. Damage claims should be forwarded to the insurance company or resolved through civil action.
